Warranty

Storage Appliance Corporation ("we", "our", "us") will, at our option, repair or replace any software product that does not operate in accordance with its written documentation (which repair may require minor upgrades, bug fixes, maintenance releases or new features or enhancements) within thirty (30) days of the date of original purchase (the "warranty period"), provided the notification to us is given within the warranty period. To verify the warranty period, an original copy of the purchase receipt is required.

Warranty provisions shall not extend the original warranty period. If we are unable to repair or replace the product, we will, at our option, for a product that has not been activated, refund the purchase price paid provided the product has been returned to us along with proof of purchase price paid. Repair, replacement or refund (if applicable) of the purchase price are the sole remedies under the warranty.

This warranty does not apply to circumstances beyond our control or to damage caused by accident, misuse, tampering, shock, electrostatic discharge, use of incompatible media or accessories, malfunctions caused by equipment with which our product is used, failure to follow operating instructions, commercial use, unauthorized repair, damage caused by fire, earthquake, flood, or other act of God, or damages due to abnormal or non-commercial operating conditions including pollution, salt, irregular power voltage, failure to follow operation instructions, failure to abide by the terms of the EULA, viruses that were not distributed with the product, or if the product has had its serial number altered. The software is not guaranteed to be compatible with your current or future software and hardware. WE MAKE NO OTHER EXPRESS OR IMPLIED WARRANTY FOR THIS PRODUCT AND DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT THAT THE EXCLUSION OF ANY IMPLIED WARRANTY IS INEFFECTIVE UNDER THE LAW, THE DURATION OF THE IMPLIED WARRANTY WILL BE THE WARRANTY PERIOD STATED ABOVE OR SUCH LONGER PERIOD AS REQUIRED BY LAW. THIS WARRANTY EXCLUDES ALL SPECIAL, CONSEQUENTIAL OR INCIDENTAL DAMAGES, EXCEPT IN JURISDICTIONS NOT ALLOWING SUCH EXCLUSIONS OR LIMITATIONS. We are not responsible for, among other things, lost data or any costs related to data recovery, removal or re-installation. Warranty service will only be provided in the country of original purchase. The product may be subject to further limitations as set out in the EULA that accompanies it.

Some states/ jurisdictions do not allow exclusion or limitation of incidental or consequential damages, so the above limitation/ exclusion may not apply. Outside the U.S. and Canada, the terms and conditions of this warranty may be different. Unless a specific warranty is communicated to you in writing by us, no warranty or liability exists beyond any minimum requirements imposed by law, even though defect, damage or loss may be by negligence or other act.
